About these terms
These terms apply to your use of this website and to goods you buy from Ferylox Ltd, a private limited company registered in England and Wales, company number 17456892, registered office 4-6 Greatorex Street, London, England, E1 5NF. Email: info@ferylox.co.uk.
Please read them before you order. If you do not agree, please do not use the website or place an order. Where we say "consumer", we mean an individual buying for purposes mostly outside their trade, business or profession.
Using this website
- The content of this website belongs to us or our licensors. You may view it for your own use but must not copy or republish it without our written permission.
- Do not misuse the site, try to gain unauthorised access, or introduce anything harmful.
- We try to keep information accurate, but it is for general information. Product descriptions and availability may change without notice.
- Links to other websites are provided for convenience. We are not responsible for their content.
Orders and quotes
- A quote is an invitation for you to order, not an offer we must accept. Quotes are valid for the period stated on them or, if none is stated, 14 days.
- A contract is formed when we confirm your order in writing, or when we dispatch the goods, whichever happens first.
- We may decline an order, for example if goods are unavailable or a price was shown in error. If we do, we will tell you and refund anything you have paid for that order.
Prices, VAT and payment
- Prices are in pounds sterling (GBP).
- Prices quoted to consumers include VAT. Quotes to trade customers may show prices excluding VAT and will say so.
- Delivery charges, if any, are shown in the quote before you agree to it.
- Payment is due as stated in the quote or invoice. We may ask for payment before dispatch.
Choosing the right part
It is important that a part suits your vehicle. Please give us accurate vehicle details, such as the registration number, and any part number you have. We will check fitment on the information you supply. We cannot accept responsibility for a part ordered on incorrect vehicle details, although we will always try to help.
Parts should be fitted by a competent person. If you are unsure, ask a qualified mechanic.
Delivery and collection
- We will give you an estimated delivery date or collection arrangement when we confirm your order. Unless agreed otherwise, we will deliver within 30 days of the day we confirm it.
- Risk of loss or damage passes to you on delivery. Ownership of goods passes to you when we receive full payment.
- Please check goods when they arrive and tell us promptly about any damage or shortage.
Cancelling and returning goods (consumers)
If you are a consumer buying at a distance (online, by phone or by email), you have the right to cancel your order for any reason within 14 days of the day you receive the goods.
- To cancel, tell us clearly in writing, for example by email. You do not need to give a reason.
- Return the goods within 14 days of telling us you are cancelling. Unless we agree otherwise, you pay the direct cost of returning them.
- Goods must be returned unused, uninstalled and in their original packaging. We may reduce your refund if goods have been handled more than is needed to check them.
- We will refund the price you paid, and standard delivery charges, within 14 days of receiving the goods back, using the same payment method.
- The right to cancel does not apply to goods made to your specification or clearly personalised.
Trade customers do not have a statutory right to cancel. Returns from trade customers are at our discretion and subject to any terms agreed in writing.
Faulty goods
Goods we supply must be of satisfactory quality, fit for purpose and as described. If goods are faulty, contact us as soon as you can. If you are a consumer, your rights under the Consumer Rights Act 2015 include a right to reject faulty goods for a refund within 30 days of delivery, and a right to repair or replacement after that. Nothing in these terms limits those rights.
For trade customers, we will repair, replace or refund goods that do not meet the description or are defective when supplied, provided you tell us within a reasonable time.
Our liability
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.
- Subject to that, and to your legal rights as a consumer, we are not liable for loss of profit, loss of business or indirect losses.
- Subject to the same, our total liability for any order is limited to the price you paid for the goods concerned.
Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control, such as supplier or carrier disruption, severe weather, or utility or internet failures. We will tell you if this affects your order and do what we reasonably can to reduce the delay.
General
- We may update these terms from time to time. The terms in force when you place an order are the ones that apply to it.
- If any part of these terms is found to be unenforceable, the rest remains in effect.
- These terms, and any dispute arising from them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
